Terms of Sale

Article 1 — Purpose and scope

These Terms of Sale govern sales of products made on the Yuka Ink website between Lucas Doutremepuich, sole trader (the "Seller"), and any non-trader individual making a purchase (the "Customer"). Any order implies unconditional acceptance of these Terms, which are made available to the Customer before the order is confirmed.

Article 2 — Products

The products offered for sale are those shown on the website at the time of consultation, while stocks last. Each product is presented with its essential characteristics. Photographs are non-contractual and provided for guidance only.

Article 3 — Prices

Prices are shown in USD, inclusive of all taxes, excluding shipping costs. As the Seller benefits from the VAT exemption scheme (Art. 293 B of the CGI), VAT does not apply. Shipping costs are shown before the order is confirmed. The Seller reserves the right to change prices at any time; products are invoiced at the price in force at the time of the order.

Article 4 — Orders

The Customer selects the products, confirms the cart, enters their details, then confirms the order and pays. Confirmation of the order forms the sales contract. A confirmation e-mail summarising the order is sent to the Customer.

Article 5 — Payment

Payment is made online at the time of the order, using the payment methods offered on the website (bank card and other options shown at checkout). Payments are secure. The order is processed only after payment has been received.

Article 6 — Delivery

Products are delivered to the address given by the Customer at the time of the order. Delivery times and terms are set out in the "Shipping policy" page. Times are given for guidance only. In the event of a delivery delay, the Customer may, under the conditions provided by law, cancel the order and obtain a refund of the sums paid.

Article 7 — Right of withdrawal

In accordance with Articles L.221-18 et seq. of the French Consumer Code, the Customer has a period of fourteen (14) days from receipt of the product to exercise their right of withdrawal, without giving any reason and without penalty.

To exercise this right, the Customer notifies their decision by an unambiguous statement (by e-mail to support@yukaink.com) or using the model form below. The product must be returned in its original condition, complete, within fourteen (14) days of communicating the withdrawal decision. In the case of a change-of-mind withdrawal, the direct cost of returning the product is borne by the Customer (the Customer is informed of this here, in advance, as required for this cost allocation to apply).

The Seller refunds all sums paid, including standard delivery costs, within fourteen (14) days of being notified of the withdrawal, using the same payment method as the one used for the order. The refund may be withheld until the product has been received back.

Exceptions to the right of withdrawal (Art. L.221-28): including made-to-order or personalised products, and sealed products that cannot be returned for hygiene reasons once opened.

Article 8 — Legal guarantees

Independently of any commercial warranty, the Seller remains bound by:

  • the legal guarantee of conformity (Articles L.217-3 et seq. of the French Consumer Code): the Customer has two (2) years from delivery of the goods to act;
  • the guarantee against hidden defects (Articles 1641 et seq. of the French Civil Code), allowing the Customer to choose between rescinding the sale or reducing the price.

Article 9 — Liability

The Seller cannot be held liable for non-performance of the contract in the event of force majeure, an act of the Customer, or an unforeseeable and insurmountable act of a third party.

Article 10 — Personal data

Data collected when placing an order is processed in accordance with the "Privacy policy" available on the website.
